En el dia de hoy, y en pararelo con el anuncio de una convocatoria extraordinaria para el 28 de abril sin orden del dia ni asuntos que tratar, 12 representantes ciudadanos y los concejales de la oposición (PSOE,C,S y CAMBIEMOS ORIHUELA) presentes en las Juntas han difundido un manifiesto sobre la situación de las Juntas de Distrito X y XI. Los firmantes califican el funcionamiento de deficiente, el incumplimiento de los acuerdos y la ausencia de una memoria anual, entre otros incumplimientos legales. Exigen la comparecencia del alcalde y sus asesores para explicar la situación.
MANIFIESTO SOBRE LA SITUACIÓN DE LAS JUNTAS DE DISTRITO X Y XI
La Junta de Distrito es el órgano máximo de participación ciudadana en el ámbito de un distrito, y sirve para la consulta, información y control de la gestión municipal, así como para canalizar las propuestas referidas a la misma, permitiendo la participación activa de los ciudadanos y las ciudadanas, individualmente o a través de las entidades ciudadanas, en la gestión de asuntos públicos propios del territorio del distrito.
Están reguladas en el Reglamento de Participación Ciudadana del Ayuntamiento de Orihuela. En la costa existen dos que se corresponden con los Distritos X y XI. En esos distritos están censados 30.000 vecinos y residen de manera habitual más de 60.000.
La Presidencia de ambas juntas recae en el Concejal de la Costa, Manuel Mestre.
En la presente legislatura las juntas de distrito se han reunido con normalidad hasta que a finales del año 2024 los secretarios de ambas dimitieron. El cargo de Secretario de la Junta de Distrito será desempeñado por personal municipal designado al efecto por el Presidente de la Junta. Desde diciembre de 2024 las juntas no han vuelto a convocarse y no hay secretarios nombrados. El funcionamiento práctico de las juntas ha sido deficiente, y por decisión mayoritaria de sus miembros se aprobó un sistema de trabajo que buscaba que estos órganos de participación ciudadana proporcionasen resultados reales.
Ese acuerdo adoptado por amplia mayoría de los miembros de las Juntas, incluidos los grupos municipales a excepción del Popular y el de Vox, que se abstuvieron, no ha sido aplicado, lo que ha producido una ineficacia estructural y, por lo tanto, un incumplimiento de sus funciones.
De hecho no se ha redactado y trasladado al Ayuntamiento una memoria anual de las necesidades del distrito, con indicación de las prioridades, en su caso, para su tratamiento y gestión municipal y poder realizar las correspondientes previsiones presupuestarias a que hubiera lugar, conteniendo el análisis del resultado de la actividad municipal desarrollada hasta ese momento en el distrito, ni se ha elaborado ni difundido un informe anual sobre el grado de participación ciudadana habida en el distrito, en colaboración con el servicio municipal de Participación Ciudadana.
Ante esta situación, también por amplia mayoría, incluyendo de nuevo a los grupos municipales de la oposición, los miembros de las juntas de distrito solicitaron la comparecencia del Alcalde de Orihuela, cuestión que permite el ya mencionado Reglamento. Una petición legal y legítima que el Alcalde lleva desoyendo meses.
El Presidente de las Juntas de Distrito X y XI no convoca las Juntas de Distrito en tiempo y forma conforme marca el reglamento y no cumple y hace cumplir los acuerdos legalmente adoptados, y el Alcalde de Orihuela muestra su desprecio por los mecanismos democráticos y los foros de representatividad de los ciudadanos. Unas Juntas de Distrito que no se convocan, que no se respetan, que no tienen consecuencias prácticas y ante las que el propio alcalde se niega a comparecer, no tienen sentido.
El comportamiento del equipo municipal supone un incumplimiento de sus propias normas y vulnera la letra y el espíritu de toda la normativa de participación ciudadana, transparencia, dato abierto, código ético y valores democráticos. Supone un infracción de, al menos, los artículos 1, 9 , 23, 29 y 53 de la Constitución Española.
Por todo ello, los miembros de las Juntas de Distrito X y XI que se relacionan en el listado anexo a este manifiesto, solicitamos
1. Que se convoquen las juntas de distrito extraordinarias pendientes, con un punto del orden del día único en cada caso:
a. La comparecencia del Alcalde de Orihuela acompañado de los cuatro coordinadores generales de área para analizar el cierre del los presupuestos del ejercicio 2024 y los presupuestos 2025.
b. La comparecencia de los máximos representantes de la administración general del Estado en la provincia, de la administración autonómica, de la administración municipal, del consejo escolar y del equipo directivo para analizar la situación en el IES Playa Flamenca.
2. Que se convoque la primera sesión ordinaria de las juntas de distrito del ejercicio 2025, con la presentación de la memoria anual de necesidades de ambos distritos y del informe anual del grado de participación ciudadana y con la elaboración del orden del día conforme al procedimiento aprobado por todos sus componentes.
3. Que se contesten a todas las cuestiones pendientes de las anteriores Juntas de Distrito.
4. Que se cumplan y se hagan cumplir los acuerdos adoptados en el seno de las Juntas de Distrito, en especial las relativas a las cuestiones de orden interno y funcionamiento de las mismas.

The District Councils of Orihuela Costa explode and ask for the presence of Mayor Vegara
Today, and in parallel with the announcement of an extraordinary convocation for 28th April with no agenda or business to discuss, 12 citizen representatives and the opposition councillors (PSOE,C,S and CAMBIEMOS ORIHUELA) present in the Juntas have issued a manifesto on the situation of the Juntas de Distrito X and XI. The signatories describe the poor functioning, the non-compliance with agreements and the absence of an annual report, among other legal breaches. They demand the appearance of the mayor and his advisors to explain the situation.
MANIFESTO ON THE SITUATION OF DISTRICT COUNCILS X AND XI
The District Council is the highest body for citizen participation in a district, and is used for consultation, information and control of municipal management, as well as for channelling proposals related to the same, allowing the active participation of citizens, individually or through citizens’ organisations, in the management of public affairs specific to the district’s territory.
They are regulated in the Citizen Participation Regulations of Orihuela Town Council. On the coast there are two which correspond to Districts X and XI. These districts have a census of 30,000 residents and more than 60,000 are regular residents.
The presidency of both councils is held by the Councillor for the Coast, Manuel Mestre.
In the current legislature, the district councils have met normally until the secretaries of both resigned at the end of 2024. The post of District Board Secretary will be held by municipal staff appointed for this purpose by the President of the Board. Since December 2024 the boards have not been reconvened and no secretaries have been appointed. The practical functioning of the boards has been deficient, and by a majority decision of their members, a working system was approved that sought to ensure that these bodies of citizen participation would provide real results.
This agreement, adopted by a large majority of the members of the Boards, including the municipal groups with the exception of the Popular and Vox groups, which abstained, has not been implemented, which has led to structural inefficiency and, therefore, a failure to fulfil their functions.
In fact, an annual report of the district’s needs has not been drawn up and sent to the City Council, indicating the priorities, where appropriate, for their treatment and municipal management and to be able to make the corresponding budgetary forecasts, containing an analysis of the results of the municipal activity carried out to date in the district, nor has an annual report on the degree of citizen participation in the district been drawn up and distributed, in collaboration with the municipal Citizen Participation service.
Faced with this situation, also by a large majority, again including the municipal opposition groups, the members of the district councils requested the appearance of the Mayor of Orihuela, as permitted by the aforementioned Regulations. A legal and legitimate request which the Mayor has been ignoring for months.
The President of District Councils X and XI does not convene the District Councils in time and form in accordance with the regulations and does not comply with and enforce the agreements legally adopted, and the Mayor of Orihuela shows his contempt for democratic mechanisms and the forums of representation of the citizens. District Councils which are not convened, which are not respected, which have no practical consequences, and before which the Mayor himself refuses to appear, make no sense.
The behaviour of the municipal team is a breach of its own rules and violates the letter and spirit of all the regulations on citizen participation, transparency, open data, code of ethics and democratic values. It is an infringement of at least articles 1, 9, 23, 29 and 53 of the Spanish Constitution.
For all these reasons, we, the members of the X and XI District Councils listed in the appendix to this manifesto, request the following
1. That the pending extraordinary district meetings be convened, with a single agenda item in each case:
a. The appearance of the Mayor of Orihuela accompanied by the four general area coordinators to analyse the closure of the budgets for 2024 and 2025.
b. The appearance of the highest representatives of the general administration of the State in the province, the regional administration, the municipal administration, the school council and the management team to analyse the situation in IES Playa Flamenca.
2. That the first ordinary session of the District Councils of the 2025 financial year be convened, with the presentation of the annual report on the needs of both districts and the annual report on the degree of citizen participation and with the drawing up of the agenda in accordance with the procedure approved by all its components.
3. That all outstanding questions from previous District Councils be answered.
4. That the agreements adopted within the District Councils are complied with and enforced, especially those relating to internal matters and their functioning.

En casi todas las regiones de España las Juntas de Distrito son tratadas con respeto, tienen mayores poderes, incluso un mayor presupuesto, PERO, como sabemos, Orihuela, en el pasado y en el presente, ha tratado a las Juntas de Distrito con desprecio, se ríen en nuestras caras porque saben que no estamos unidos como un todo, Es muy importante la cantidad y calidad de los firmantes, No tienen vergüenza. Luego quieren dar lecciones de democracia.
In nearly every region of Spain district Boards are treated with respect, have greater powers even a bigger budget, BUT, as we know Orihuela past and present have treated the District Boards with contempt, they laugh in our faces because they know we are not united as a whole, They have no shame, Then they want to give lessons in democracy.
